RTX warrants that each software
program furnished to Customer will be in good
working order for a period of 90 days from the date of shipment
by RTX. RTX's entire liability and Customer's
exclusive remedy shall be, at RTX's option, either the
return of the purchase price or replacement of the software
program that does not meet RTX's "Limited
Warranty". If failure has resulted from accident, abuse,
misuse, misapplication, or use on defective or non-compatible
equipment, RTX shall have no responsibility to replace the
software program or refund the purchase price. Any replacement
will be warranted for the remainder of the original warranty
period or 30 days, whichever is longer. RTX does not
warrant that the software programs will meet Customer
requirements or operate in the combinations Customer
may select for use, or that the operation of the software
programs will be uninterrupted or error-free.
EXCEPT AS EXPRESSLY PROVIDED IN
THE LIMITED WARRANTY ABOVE, THE LICENSE SOFTWARE IS PROVIDED
"AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED
OR IMPLIED INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
